Social security

Foreign researchers who work and reside legally in Portugal, along with their families, are subject to the same rights and obligations as Portuguese nationals, except where international instruments apply (see International Coordination of Social Security Legislations). They enjoy, in the same way as Portuguese nationals, protection under different schemes, according to the professional activity they pursue:
- Employees – General Social Security Scheme
- Self-employed persons – General Social Security Scheme
- Research Fellows – Voluntary Social Security Scheme

Enrolment
Employers’ obligations
- Notify the social security offices of the admission of new
workers through form model RV1009-DGSS (in portuguese), or
by any written means or through www.seg-social.pt, at
Segurança Social
Directa (in portuguese).
The employer should communicate the admission of new employees:- in the 24 hours preceding the work contract coming into force or
- within 24 hours after the beginning of activity if it has not been possible to inform the social security offices within the above mentioned period due to duly justified exceptional reasons related to the celebration of very short term contracts or work in shifts.
This communication does not exempt the employer from including new employees in the pay slips of the month correspondig to the beginning of their activity.

Register the workers who start to work for them till the end of the month following the beginning of activity, through form model RV1005-DGSS (in portuguese).
Enrolment becomes effective from the 1st day of the month of the beginning of activity.

Deliver to their new employees a statement with reference to the date of the new employees’ admission and the social security number (NISS) and the tax payer number (NIF) of the employer.
Failure to comply with these obligations will be considered an infringement and result in the application of the corresponding sanctions.
Employees’ obligations
The employees are under the obligation to communicate to the social security office the beginning of his/her activity or his/her link to a new employer, as indicated below:
- When
- Till 24 hours after the beginning of the work contract which links the employee to the employer.
- Where
- In the social security offices(in portuguese) or in a Loja de Cidadão (in portuguese).
- How
- Through form model RV1009–DGSS (in portuguese), accompanied by the documents mentioned there.
False information concerning the registration with social security will result in penalties.
Contributions
Contribution Amounts
Contributions for most employees are calculated at the global rate of 34.75% on salaries, corresponding:
- 11% to the employee and
- 23.75% to the employer.
Contributions to be made by employees are deducted from salaries and paid to Social Security by the employer.
Payment of contributions
The payment of contributions is the responsibility of the employer. Contributions must be paid monthly between the 1st and the 15th day of the month following the one to which the payments refer.

Self-employed persons
Enrolment
Workers who initiate an activity as self-employed persons are required to register at the social security office, if they have not already done so.
Enrolment to this scheme is:

Mandatory for those self-employed persons whose gross yearly income is higher than 6 times the value of IAS (that replaces the national minimum salary as a reference for calculating pensions, benefits and contributions).
For first time self-employed persons, enrolment is not compulsory during the first 12 months.

Voluntary for those self-employed persons whose gross yearly income is equal to or lower than 6 times the value of the IAS or for those who have been affiliated for less than one year, subject to a claim.
The enrolment should be formalized as follows:
- When
-
- Until the 15th day of the 13th month following the month of the beginning of the activity for first-time self-employed workers, if the gross yearly income is higher than 6 times the value of IAS.
- Until the 15th day of the 2nd month following the month when the activity started, for workers who re-start an activity as a self-employed person.
- Where

In the social security office of your area of residence or in a Loja de Cidadão (in portuguese).

Contributions
The amount of the contribution is calculated by applying a rate to a salary (basis for the calculation of contributions) chosen by the interested person from among the following 10 levels of earnings indexed to the IAS:

The amount of the contribution varies according to the scheme of protection: compulsory (more restrictive) and extended.

- Extended scheme
- 32%
Contributions must be paid monthly between the 1st and the 15th of the month following the month to which contributions relate:

Research Fellows
Research fellows participating in scientific research projects may join the Voluntary Social Insurance Scheme, provided they are:
- Above the age of 18;
- Fit for work;
- Not covered by compulsory social security schemes, or if covered, these are not binding for the Portuguese social security system;
- Either:
- National citizens pursuing an activity in Portugal or abroad, whenever the fellowship is awarded by national organizations; or
- Foreigners or stateless persons pursuing their activity as fellow researchers in Portugal, irrespective of the length of the period of residence, whenever the fellowship is awarded by national organizations.
Enrolment
As a rule, enrolment is the responsibility of the person covered.

At the social security office of the interested person’s place of residence, or in a Loja de Cidadão (in portuguese).

Through form RV1007-DGSS (in portuguese), together with the documents mentioned in it:
- Identity card, Birth certificate or other;
- Affidavit statement certifying that the claimant is not covered by any compulsory social security scheme;
- Residence certificate, in case of foreigners or stateless persons, including third country nationals that are not bound by a social security agreement or convention;
- Medical certificate attesting that the interested person is capable of work.
- Certification of research fellow status, issued by funding institution.
Contributions
Contributions are calculated by applying a rate of 20% to a salary chosen by the applicant as basis for the calculation from among 6 levels of earnings indexed to the IAS:

Funding institutions are responsible for the payment of contributions corresponding to the 1st level of earnings. Research fellows are responsible for the payment of contributions corresponding to higher levels of earnings.
Benefits
Social protection is guaranteed to scientific research fellows through the following benefits covering the following risks (granting of benefits depends on the fulfilment of the qualifying conditions required by the general social security scheme for employees):
- Sickness (does not cover the first 30 days)
- Maternity, paternity and adoption
- Occupational Diseases
- Disability (requires a minimum of 72 months of contributions)
- Old age (requires a minimum of 144 months of contributions)
- Death
- Family benefits
